Waiver of Liability and Declaration of Consent

1. Participation at Your Own Risk

I am voluntarily participating in yoga classes, wellness programs, trainings, or workshops, during which I will receive instruction and information regarding yoga and health. I am aware that yoga requires physical exertion, which can be strenuous and may cause physical injury. I fully acknowledge the risks and hazards involved.

2. Medical Fitness

I confirm that it is my sole responsibility to consult with a physician prior to participating to determine my medical fitness. I represent that I am physically capable of fully and safely participating in the classes, programs, or workshops, and that no health limitations exist that would prevent this.

3. Assumption of Risks

In consideration of being permitted to participate, I assume full responsibility for any risks, injuries, or damages—known or unknown—that I may incur in connection with my participation.

4. Waiver of Claims

I hereby knowingly, voluntarily, and expressly waive any claims against Miloš Borojević or Studio Sun & Sea resulting from injuries or damages that I might sustain as a result of my participation.

5. Limitation of Liability

The liability of Miloš Borojević and Studio Sun & Sea for slight negligence is excluded, provided that it does not concern essential contractual duties (cardinal obligations), injuries to life, body, or health, or guarantees. Liability for gross negligence, intentional misconduct, and statutory product liability remains completely unaffected.

6. Online Instruction

I acknowledge that additional risks exist during online classes, as the provider cannot monitor my physical surroundings. I am solely responsible for creating a safe practice space, removing obstacles, and ensuring suitable conditions for my participation.

7. Governing Law, Jurisdiction, and Severability

For all services physically broadcast, streamed, or rendered from our location in Texas, or taught in person within the United States of America, this Declaration shall be governed exclusively by the laws of the State of Texas. For all services broadcast, streamed, or rendered while the instructor is physically located within Europe, or taught in person within the European Union, the laws of the Federal Republic of Germany shall apply exclusively.

If any provision of this Declaration is held to be invalid, the remaining provisions continue in full force.

8. Understanding and Consent

I have completely read and understood this Declaration. I voluntarily agree to all the terms and conditions stated above.
