2. Scope of Services

Studio Sun & Sea provides yoga instruction, wellness education, and related services both online and in person. Online courses are broadcast from private dedicated spaces in Germany and the USA. Physical, in-person classes in Germany are conducted at rented studio premises.

Studio Sun & Sea does not provide medical, therapeutic, or clinical services.

2a. Kunga Yoga Service Commitment

Certain classes offered by Studio Sun & Sea are taught in the Kunga Yoga tradition, which emphasizes service, compassion, and community engagement. As part of this tradition, a portion of the proceeds from Kunga Yoga classes is donated to charitable organizations supported by the Kunga community. This donation is made by the studio and does not create any financial obligation for participants beyond the standard class fee.

3. Eligibility

Participants must be at least 18 years old or have written consent from a parent or legal guardian.

4. Health and Medical Responsibility

You are responsible for ensuring that you are physically and medically fit to participate in yoga or wellness activities. You should consult a physician before beginning any new exercise program. By participating, you represent that you have no medical condition that would prevent safe participation.

5. Assumption of Risk

Yoga and physical movement involve inherent risks, including strain, imbalance, falls, and aggravation of existing conditions. By participating in any service, you acknowledge and voluntarily accept these risks.

6. Limitation of Liability

The liability of Studio Sun & Sea and its owner for slight negligence is excluded, provided that it does not concern essential contractual duties (cardinal obligations), injuries to life, body, or health, or guarantees. Liability for gross negligence, intentional misconduct, and statutory product liability remains completely unaffected. This modified limitation applies globally within the maximum boundaries permitted by local laws.

7. Online Class Safety

For online sessions, you are responsible for ensuring a safe practice environment, including adequate space, removal of hazards, and stable equipment. Studio Sun & Sea cannot monitor your environment and is not responsible for injuries occurring during online practice.

8. Payment, Booking, and Cancellation

Prices, booking conditions, and cancellation policies are displayed at the time of purchase or registration. EU consumers retain statutory withdrawal rights where applicable under EU law.

9. Intellectual Property

All content, including videos, written materials, graphics, and class recordings, is protected by copyright. You may not reproduce, distribute, or share content without prior written permission.

10. Privacy and Data Protection

Personal data is processed in accordance with the Privacy Policy. EU data subjects retain all rights under the GDPR.

11. Professional Liability Insurance

Studio Sun & Sea is insured through Markel Insurance SE via Exali AG.

The insurance provides coverage for insured activities worldwide, subject to the terms and exclusions of the policy. Only the German-language policy document is legally binding.

12. Governing Law and Jurisdiction

For all services physically broadcast, streamed, or rendered from our location in Texas, or taught in person within the United States, these Terms are governed exclusively by the laws of the State of Texas. For all services broadcast, streamed, or rendered while the instructor is physically located within Europe, the laws of the Federal Republic of Germany apply exclusively.

13. Dispute Resolution

The European Commission provides a Consumer Redress Hub for consumer dispute settlements, accessible at: https://consumer-redress.ec.europa.eu/. Studio Sun & Sea is not obligated or willing to participate in consumer arbitration.

14. Release and Waiver of Liability

Participation in services requires acceptance of the Release and Waiver of Liability. The waiver supplements these Terms and remains valid for all services provided.

15. Changes to These Terms

Studio Sun & Sea may update these Terms from time to time. The version in effect at the time of booking or participation applies.
